Yesterday the state Senate and House debated whether our Tennessee Supreme Court justices should once again be elected in a regular contested election process or continue to be appointed by the Governor for up to two years and then only face a retention election. Well, it has been said there are two things you never want to see made, sausage and legislation. Who Judges the Judges? (or Letting a Majority of Foxes Decide Who Gets to Guard the Henhouse!)

 
 

Since 1994 an appointed group of people, called the Judicial Evaluation Commission, have met to decide whether a Supreme Court or intermediate appellate court Judge, appointed by the Governor, should be allowed to run for retention election. That makes it an important and powerful committee. And you’ll be shocked to know who is in control of it. Surely the state Senate will insist that this be fixed.
